The dangers of AI tools are often spoken about, and now we are seeing the impact of these systems from a legal perspective as data protection activists accuse ChatGPT of a potential GDPR breach.

If the accusations are true, it would be very concerning with the activists claiming ChatGPT processed and stored personal data without obtaining the necessary consent, potentially violating users' privacy rights.

Whereas companies are obliged to provide audit trails to individuals under GDPR, AI tools such as ChatGPT struggle to hand this information over.

From my perspective, it would be advisable to thoroughly investigate the allegations and review the practices of ChatGPT in terms of data handling. OpenAI should assess whether any personal data was being stored and determine whether it was done in compliance with GDPR obligations before taking corrective action to remediate any non-compliance issues.
